If you are pulled over, questioned or arrested, don't give police additional grounds for arrest by being argumentative or hostile. But you do have rights, including the right to refuse to answer questions, to refuse field sobriety tests and to talk to a lawyer. The key is to be calm and polite in informing the officer, and to insist on speaking with an attorney before giving samples or statements. You must take a blood alcohol test, but you do not have to take a field sobriety test or a P.A.S.T. test, nor do you have to agree to be searched or to have your car or home searched.
