Discriminatory Law Enforcement

San Jose, San Francisco, Oakland, Santa Cruz and Santa Clara Discriminatory Law Enforcement Lawyers

Do you think law enforcement in your area is not enforcing the laws fairly? Are the police only arresting certain kinds of people for certain types of crimes? Are law enforcement officers arresting people in your neighborhood based on racial profiling?

Discriminatory enforcement of laws violates the United States Constitution. A victim of discriminatory law enforcement has the right to file a civil rights lawsuit against the law enforcement agency at fault.

From our office in San Jose, The Law Firm of Kallis & Associates, P.C., evaluates claims of police misconduct and civil rights violations throughout the San Francisco Bay Area and northern California. Since opening the law firm in 1997, Jeff Kallis has built a reputation as an aggressive San Jose discriminatory law enforcement defense attorney with the resources necessary to fight back on his clients' behalf against some of our state's most powerful agencies. Racial and National Origin Profiling

One type of discriminatory enforcement of laws involves racial profiling. The most basic example of a racial profiling arrest is the following situation: Two men are walking down the street displaying the same signs of intoxication. The police arrive on the scene and arrest the African-American man but not the Caucasian man.

Another example involves the police only questioning those of a certain race. If a storeowner reported a robbery but did not see the robber's face, the police may only question Hispanics or African Americans for no other reason than they "appear more guilty" than a white person.

Racial discrimination is illegal and a clear violation of your civil rights. You have the right to pursue compensation if you are a victim of this injustice.

Attitude Adjustment Arrests

Another type of discriminatory enforcement of laws occurs when police arrest someone because they do not like the victim's "attitude." Attitude adjustment arrests or false arrests may be discriminatory in a specific jurisdiction if they happen more frequently to people of a specific race or people who belong to another protected class of people. Examples of attitude adjustment charges include:

  • Resisting arrest
  • Disturbing the peace
  • Public drunkenness

If statistics show that the police in your city arrest more black people than white people for public drunkenness, that may be an example of discriminatory law enforcement. If statistics show that the arrest rate for disturbing the peace is higher in your town for gay men than for any other group of people, that may also be a case of discriminatory enforcement of laws.
